Governor Christie Takes Office, Signs Eight Executive Orders

On January 20, 2010, one day after taking office with Lieutenant Governor Kim Guadagno, Governor Christie signed eight executive orders. The first four focus on reforming the State’s regulatory morass. They include directives which impose a State “time of decision” mandate, create a “Red Tape Review Group”, and freeze pending state regulations.

Permit Extension Signed. WQMP Vetoed.

Thanks to all of your phone calls, on Monday, January 18, 2010, former-Governor Jon Corzine signed the Permit Extension Act Renewal as P.L. 2009, c.336.  As signed by the Governor, this law would extend the majority of municipal, county, and regional approvals to December 31, 2012. (The existing act is set to expire on July 1, 2010.) The change of date is the only change made to the Permit Extension Act of 2008.  Text of the “Permit Extension Act Renewal” is available at:

Unfortunately, the former-Governor did not sign the Wastewater Planning Extension Bill (A4345 Green/Scalera/Sarlo/Oroho) before leaving office.  However, based on the wide margins by which the bill passed the Legislature, the NJBA is optimistic that there will be resolution on this issue in the future once newly-elected Governor Christie completes his evaluation of the State’s regulations.  Text of the Wastewater Planning Extension Bill (which was not enacted) is available at: http://www.njleg.state.nj.us/2008/Bills/A4500/4345_R2.PDF.

Realize Savings though the NJBA Member Rebate Program!

Since initiating and taking advantage of the Member Rebate Program, NJBA members saved $8254.00 and realized an average rebate of $1179.14 through the first quarter of participation in the program! The Q3 2009 rebate form for purchased made from April 1st – September 30th is now available and must be completed and returned by November 25, 2009.

Wanted:  Members Interested in Building Affordable Housing

NJBA is compiling a list of developers who are interested in the opportunity to build affordable housing for municipalities and non-profits in order to fulfill municipal affordable housing obligations.  Over $238 million in unspent development fees is currently sitting in municipal housing trust fund accounts.  In P.L. 2008, c.46, municipalities are required to spend their remaining share of trust fund money within four years, or the money reverts to the state.  The development community could help spend this money and provide much needed affordable homes to families.

Governor Signs Economic Stimulus Act

On July 27, 2009 Governor Jon Corzine signed the Economic Stimulus Act of  2009 (P.L.2009, c. 90).  As signed by the Governor, the law includes several provisions to encourage residential development in urban areas.

Governor Signs Age 55+ Legislation

On July 2, 2009 Governor Jon Corzine enacted S2577 (Sarlo/Vitale/Greenwald/Malone). The law takes effect immediately and would allow for the conversion of certain age-restricted housing developments pending approval by a municipal planning or zoning board.  In order for a project to be eligible for a conversion, a developer must meet certain requirements...

Licensed Site Remediation Professionals (LSRP) Bill Signed

On May 7th, Governor Corzine signed the long-awaited LSRP bill, which is the culmination of more than two years of discussions between the NJDEP, State Legislature and various stakeholders. An Executive Order was also issued in conjunction with the enactment. The bill was passed in late February with overwhelming support of both legislative houses. NJBA’s Environmental Counsel, Andy Robins (Giordano, Halleran & Ciesla, P.C.), has been instrumental in representing the interests of the Association in this process.

New NJDEP document re: Wastewater Management Plans

NJDEP has posted on its website a new "FAQs"; document regarding the implementation of the Water Quality Management Plans.  This document discusses a number of issues that NJBA has raised to NJDEP, including preparation of the Wastewater Management Plans, how the new sewer service areas are delineated and the public notification process to alert landowners about proposed property status.

MEMBER ACTION NEEDED RE SEWER SERVICE AREAS

As part of the sewer planning process, NJDEP has given all Counties draft mapping of where DEP thinks sewer service area (SSA) boundaries should be, regardless of the County's acceptance of wastewater management planning responsibility.  NJBA has learned that DEP has “clipped” (or taken out) properties from proposed SSAs in the maps provided to the Counties.  We also have received conflicting information as to whether properties with valid sewer extension permits are also being clipped from the SSAs.
